Rental conditions
1. The agreement shall be deemed concluded when SOS receives a copy of the rental proposal signed by the customer at its premises.
2. The contracting party, in addition to the obligations foreseen by art. 1587 of the civil code, undertakes: to use the vehicle solely for personal needs; to use the steering lock at each stop and to lock the vehicle with a key, keeping it and the vehicle in safekeeping.
The policyholder, in addition to the obligations provided for in art. 1587 of the Civil Code, undertakes: to use the vehicle solely for personal needs; to use the steering lock device at every stop and to lock the vehicle with a key, keeping the key and the vehicle's registration documents; not to use the vehicle outside of not to use the vehicle outside of Italy; not to tow other vehicles and not to tow trailers; not to use the vehicle to transport goods. The policyholder declares and guarantees that the vehicle will only be driven by the persons indicated in the rental proposal.
3. The Policyholder declares that the rented vehicle is equipped with a spare wheel, wheel or tyre inflation kit, standard tools, triangle, safety jacket, registration card, valid insurance certificate. The Policyholder declares that the rented vehicle is equipped with a spare wheel, a fifth wheel or an inflation kit, standard tools, a triangle, a safety jacket, a registration card and a valid insurance certificate.
4. The policyholder declares that he is aware that the policy for the rented vehicle carries the following insurance deductibles:
Car: euro 500
Scooter: euro 250
The Policyholder declares that he is aware that the policy for the rented vehicle contains the following insurance deductibles: Car: € 500 Scooter: € 250 to cover damage to the rented vehicle or vehicle and that in the event of an accident he must pay these sums into the cash office of the Lessor when returning the vehicle. The contracting party expressly accepts that in the event of a breach of any of the obligations set out in article 2, as well as in the event of theft/damage caused to the rented vehicle through the client's own wilful misconduct or negligence, any exclusion and/or limitation of liability shall not apply.
5. The Policyholder is obliged to communicate and report in writing to the Lessor within and no later than 24 hours of the event occurring, any incident of minimal importance and of whatever nature, which occurred during the rental period and which is likely to produce the consequences mentioned in the previous and following points, specifying the circumstances, evidence and testimonies in favour. In the event of theft and/or total or partial fire of the vehicle, the Policyholder is obliged to immediately report it to the competent authorities and to return the vehicle to its owner.
In the case of theft and/or total or partial fire of the vehicle, the policyholder is obliged to report it immediately to the competent authorities and to return the keys to the vehicle, as well as to hand over the original report to SOS.
6. The contracting party declares that he/she shall be solely responsible for all the consequences of any fines that he/she may incur as a result of using the vehicle during the rental period, whoever they may be, and he/she undertakes to settle them when conciliation is permitted.
7. The contracting party undertakes to pay SOS: a) the reimbursement of the expenses incurred for the recovery of the vehicle that has not been delivered to the agreed place for any reason whatsoever; b) what is due in general as compensation and/or indemnity and/or reimbursement as a consequence of the responsibilities and obligations assumed by signing this contract. c) the reimbursement of the expenses advanced by SOS to have any goods that the customer has left in the rented vehicle removed.
8. During the rental period, the costs of fuel and lubricants, as well as the costs of routine maintenance, shall be borne by the policyholder.
9. The Policyholder is obliged to pay the agreed rental price of € 1.00 __ i.e. (one euro ______) i.e. per day, both if no advance payment is made, and if it is necessary to make an adjustment between the advance payment and the actual final price, and if the contracting party hires the vehicle as a driver for third parties or companies or institutions, authorising SOSAutomotive S.r.l. to demand payment in the form it deems most appropriate.
10. If this contract is registered, the relative expenses, including any surcharges and penalties, shall be borne exclusively by the contracting party. For any possible dispute, the contracting party and the law as the only competent judicial authority is the judicial authority of La Spezia (SP) section detached of Sarzana.
11. Failure to return the vehicle after the date and time indicated in the exit section integrates the crime of embezzlement, with the right of the company to request precautionary measures and any other type ex law provided for the protection of its interests, without prejudice to any wider right, including compensation.1.
